Article 1 - Definitions

We use the following terms, the definition of each term is explained below:

• 
  Cooling-off period: the period of 14 days during which you can make use of your right of withdrawal.

  Right of withdrawal: the possibility to rescind the agreement at
  a distance within the cooling-off period.
• 
  Product/ offer: the products that Gecko offers via the webshop.
• 
  You/ your/ yours: any natural person who places an order via the
  webshop and is a consumer in the sense of the law.
• 
  Day: calendar day.
• 
  Distance agreement: an agreement that comes into existence between you and Gecko via the webshop, without any physical contact having taken place.
• 
  General Terms and Conditions: these terms and conditions of Gecko.

Article 3 - The agreement

• The agreement comes into existence as soon as you accept the offer (the contents of your shopping cart) and enter into the associated payment obligation  (checkout).
• Gecko usually confirms your successful order within half an hour by email.
• Gecko reserves the right to refuse an order for valid reasons, such as: incorrect or incomplete customer details, suspicions of fraud or limited availability of the product.
• Complaints about the order or agreement can be reported via   info@gecko-wallet.nl.

Article 4 - Applicability

• These General Terms and Conditions apply to any offer and any agreement between Gecko and you.
• You can always view the General Terms and Conditions in advance; they can be found on our website

• For electronic agreements, we make the terms available in an accessible and digital manner so that you can save
  or print them.
• If, in addition to these terms, additional product or service terms and conditions apply, in case of contradictions, the provision most favourable to you always applies.

  Privacy and cookies: Gecko processes personal data in accordance with the GDPR and other privacy legislation. More information about how
  we use your data and which cookies we place can be found in our Privacy Policy. By placing an order, you also agree to our privacy policy.

Article 5 - The offer

• All offers from Gecko are non-binding. The final agreement only comes into existence when you place an order and it is confirmed by us.
• We do our utmost to represent product images as truthfully as possible as they are. However, images may sometimes (for example due to the use of renders or animations) differ slightly from reality.
• Our offer always contains the most important information, including: prices including taxes, any shipping costs, the right of withdrawal, available payment methods and product variants such as colors or models.

Article 6 - Right of withdrawal

• You have the right to rescind your order up to 14 days after receipt without stating a reason.
• Within this period, you may assess the product as you would in a physical store. During the cooling-off period, you must handle the product and the packaging with care.
• If you have gone further than is necessary to establish the nature, characteristics and functioning of the product and thereby damage has occurred to the product, Gecko may charge a reduction in value for this.
• To make use of the right of withdrawal, you must notify us within 14 days after receipt via our contact form. You then have another 14 days to return the product.
• Exceptions: products that have been customized or personalized according to your specifications cannot be returned.

Article 7 - Costs and consequences of withdrawal

• The customer is responsible for the costs of returning an order, unless the product is defective or delivered incorrectly.
• For returns from the Netherlands, Belgium and Germany, the return costs are € 5.95, including return processing. For returns from other countries, the costs are borne by the customer. The current return terms are stated in the return policy on our website.
• In the event of a full withdrawal, we will refund the purchase price and the original standard shipping costs, insofar as these were charged at the time of the order. Any additional costs for a more expensive shipping method than our standard shipping will not be refunded.
• We may postpone the refund until we have received the product or until the customer has demonstrated that the product has been returned, whichever happens first. The refund will take place within the statutory period at the latest.
• The customer may assess the product as would be possible in a physical store. In case of a reduction in value due to use that goes further than is necessary to establish the nature, characteristics and functioning of the product, we may charge a reasonable reduction in value.
• We advise the customer to keep a shipping receipt until the return shipment has been processed.

Article 8 - Prices and discounts

• You always pay the price displayed in the webshop at the time of ordering .
• Prices of products, shipping costs and any shipping thresholds may change daily.
• Any discounts or promotions are not applied retroactively .

Article 9 - Warranty

• Gecko stands for high-quality products and does everything possible to guarantee this quality.
• We offer a 2-year warranty on manufacturing defects of our MagSafe wallet and card holder, calculated from the date of delivery.
• The warranty covers only problems caused by the product itself. Damage due to normal use, careless use or accidents is not covered by the warranty.
• If you receive the product broken or defective, we will send a new product free of charge or repair the product, depending on the situation.
• You can submit warranty complaints via support@gecko-wallet.nl.

Article 10 - Delivery

• Orders are shipped from the Netherlands. Orders are generally processed the same day and shipped if they are placed on Monday through Friday before 11:00 p.m., on Saturday before 11:00 p.m. or on Sunday before 6:00 p.m..
• The expected delivery time is generally 1 day for the Netherlands, Belgium and Germany, a maximum of 3 business days for the rest of the EU and a maximum of 5 business days outside the EU. These delivery times are indicative. Deviating delivery times are stated with the product.
• The current shipping costs and conditions for free shipping are stated in the shipping policy and during checkout.
• The risk of loss or damage remains with Gecko until the order has been delivered to the customer or a designated third party.
• For countries to which we ship, the available destinations and any restrictions apply as shown in the webshop and during checkout.

Article 11 - Payment

• Orders at Gecko are paid for directly in the shopping cart via the available payment methods.
• The agreement is only completed after the payment has been successfully completed.
• If a company or organization orders from us and receives an invoice, a payment term of 14 days after the invoice date applies, unless otherwise agreed in writing.

Article 12 - Complaints procedure

• Do you have a complaint about our products or services? Then contact us as soon as possible via info@gecko-wallet.nl.
• We aim to respond substantively to your complaint within 14 days after receipt. If more time is needed, we will inform you about this.
• If we cannot come to a solution together, you can find information about independent dispute resolution via the European portal for consumer rights: https://consumer-redress.ec.europa.eu/.
• This complaints procedure does not affect the statutory rights of the consumer.

Article 13 - Amendment of the terms

• Gecko may change or supplement these general terms and conditions.
• For an order, the general terms and conditions that apply at the time the agreement came into existence apply, unless a later amendment becomes legally applicable.
• The current version of the general terms and conditions is published on our website.
• In case of substantial changes you will be informed in a timely manner. If you do not agree with the change, you have the right to rescind the agreement before the effective date of the change.

Article 14 - Applicable law

• Dutch law exclusively applies to all agreements and these General Terms and Conditions.
• Any disputes will be submitted to the competent court in the Netherlands.
